Last Friday Leeds United accepted the Football League's offer of an independent panel to hear their appeal against the 15-point penalty imposed at the start of this season. The date for Leeds United's arbitration hearing into their 15-point penalty will
take place during the week commencing April 14th, 2008.
Such a late date seems to make little sense given the fact that Leeds United had asked for the three-man panel to sit as soon as possible to hear the appeal because the season is due to end on May 3rd, 2008. As Leeds United initiated the legal proceedings against Mawhinney's Football League they must be ready for the fight. It would, therefore, seem that, despite the warnings emanating from Elland Road for over a month, the Football League either took no steps to meet the challenge or in fact knew that it has no case in law to justify the swinging penalties arbitrarily imposed on Leeds United. Consequently, it looks like the Football League realise they will have to give the points back and wish to do so as late as possible to prevent Leeds United gaining any momentum from the return of the points.
By the time arbitration takes place McAllister will have just three games remaining (Millwall, Yeovil Town and Gillingham) to build upon any points returned to his side. If the points were returned now Leeds would leap into an automatic promotion spot.
